The petitioner is seeking compassionate appointment in the light of the death of his father on 27.02.2019 while being in employment.

The respondent/Municipal Council, Jalna, has filed an affidavit in reply dated 16.09.2022. The list of eligible candidates is placed from page No.40 (annexure R-2). The petitioner's name in this updated list is at Sr.No.25. 3.

It is stated in paragraph 6 of the affidavit that as and when the turn of the petitioner comes, he would be given an

In view of the above, this Writ Petition is disposed off.

We deem it appropriate to record that the Municipal Council, Jalna, shall not unjustifiably appoint a person on compassionate basis who is below the serial number of the petitioner. Since the petitioner belongs to the Scheduled Caste category, his case may be considered on preferential basis, if permissible in law.
