Heard the respective counsels and the learned APP for the State.

The applicants seek bail in Crime No.232 of 2024 registered with Nandurbar City Police Station, District Nandurbar for
(2) the offences punishable under Sections 302, 114, 323, 504, 201 r/w 34 of the Indian Penal Code.

On perusal of the matter, the Court expressed disinclination to grant bail to the applicant - Yash @ Yadnesh Harish Chaudhari And Another in Bail Application No.1256 of 2024 and the applicant - Gaurav Sanjay Sonawane (Chaudhari) in Bail Application No.1250 of 2024. Learned counsel for the applicants seeks leave to withdraw both the applications.

Leave granted. Bail Application Nos. 1256 of 2024 and 1250 of 2024 stand dismissed as withdrawn.

So far as the applicant - Gaurav Rohidas Khedkar is concerned, after hearing both the counsels at length and going through the papers, the Court is of the view that the material collected against the applicant was balanced. The CCTV footage reveals that the applicant had just went to the hotel, smoke a cigarette and left. No incriminating evidence has been recovered at his instance. Considering his alleged role attributed, the Court is of the view that his detention would serve no purpose. Hence, he deserve bail. Hence, the following order :
O R D E R
(i) Bail Application No.1251 of 2024 is allowed.
(3) (ii) Applicant, Gaurav Rohidas Khedkar (Bhoi) in Bail Application No.1251 of 2024, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount in the above crime, on the conditions that (a) The applicant should not tamper with the prosecution witnesses and should attend the trial on each and every date. (b) The applicant should not contact other co-accused till the trial is concluded.
