5TH OCTOBER, 2015 ORDER:

1.

Leave to amend granted.

2.

Learned counsel for the petitioner tenders across bar a photo copy of validity certificate under schedule 'C' bearing No. AAA 17804 dated 23-02-2011 issued by the Divisional Caste Certificate Verification Committee, Latur. The same is taken on record and marked 'X' for the purpose of identification. 3.

Learned Assistant Government Pleader for respondent no. 1 and learned counsel for respondents no. 2 and 3 do not dispute veracity of the claim made on behalf of the petitioner. 4.

Learned counsel for petitioner points out that said validity certificate which is dated 23-2-2011 has been received at

WP-7442.15 petitioner's end after the order of this court dated 23-07-2015 directing acceptance of his nomination provisionally. It is further being pointed out that the claim for validity had been submitted pursuant to the procedure prevailing in 2010 in gram panchayat elections and the same stands fortified in view of the fact that the certificate had been issued on 23-2-2011, albeit, the same has been issued to petitioner recently.

6.

In view of aforesaid undisputed position about eligibility of petitioner, nothing further survives for decision in the petition and the same stands disposed of accordingly.
