This is an application for bail under Section 439 of the Code of Criminal Procedure. The applicant has been arrested in connection with Crime No.0787/2018, registered at Rahuri Police Station, District Ahmednagar, for the offences punishable under Sections 406, 409, 420 of the Indian Penal Code. 2.

Heard. Perused the First Information Report (FIR) and related papers.

The applicant has been in jail since June - 2022. He is alleged to have misappropriated a sum of Rs.2,47,907/-. The applicant'

s wife is present in the Court. She, on her own,

(( 2 )) 958-BA-1201-2022 undertakes to pay back the amount allegedly misappropriated by the applicant. She, however, seeks some time for depositing the amount. 3.

In view of the above, the application is allowed in terms of the following order:

O R D E R

(i) The Bail Application is allowed.

(ii)The applicant be released on bail in connection with Crime No.0787/2018, registered at Rahuri Police Station, District Ahmednagar, for the offences punishable under Sections 406, 409, 420 of the Indian Penal Code, on his executing P. R. bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with surety bond of the like amount.

(iii)The applicant shall deposit with the trial Court, a sum of Rs.1,20,000/- (Rupees One Lakh Twenty Thousand) as condition precedent for release on bail. The balance amount shall be deposited within a period of four months thereafter.

(iv)The trial Court may pay back the amount to the bank concerned on conditions to be imposed by it.

(v) The applicant shall not tamper with the prosecution evidence.
