Heard the learned counsel for the applicant and the learned A.P.P. for the respondent/State.

The applicant seeks bail in C.R.No.37 of 2024 registered with Police Station Dhoki, District Dharashiv (Osmanabad), for the offences punishable under Sections 302, 143, 147, 149, 504, 506 of the Indian Penal Code.

It has been alleged against the applicant that he alongwith others assaulted the deceased on the suspicion of stealing the mobile handset. The deceased was beaten by sticks and sugarcane in front of sugar factory. The applicant died of multiple injuries. The situation in which the incident happened is self-

952-BA-1258-24.odt speaking. There may be a question, whether the act of the applicant was intention, deliberate and omission. Nothing is recovered from the applicant. There are no antecedents to his discredit. The chargesheet has been filed. The applicant has roots in village Vida, Taluka Kaij, District Beed. 4.

In view of the above observations, the Court is of the view that the applicant deserves bail. Hence, the following order :-

ORDER

i) The application is allowed.

ii) Applicant Santosh Dadarao Waghmare be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in the above crime for the aforesaid offences, on the conditions that, (a) He should not tamper with the prosecution witnesses.
