It is correctly pointed by learned counsel Mr. Kadethankar for Respondent No.3 and 4 that this petition cannot be entertained for the reason of substantive appeal under Rule 17 (iv)(b) of the Maharashtra Civil Services (Discipline and Appeal) Rules, available to the petitioner. 2.

Perusal of the aforesaid Rule shows that the grievance of denial of promotion is appealable under the said Rule and only on that ground, we refuse to entertain the present petition. 3.

Writ Petition is dismissed.

Needless to state, the petitioner shall be at liberty to avail of remedy of appeal as indicated herein above.
