Heard the learned counsel for the applicant and the learned A.P.P for the respondent State.

The applicant is seeking bail in Crime No. 46 of 2023 registered with Police Station Aundha Nagnath, District Hingoli for the offences punishable under Sections 8(c), 20(b)(ii), 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

The similarly situated co accused have been granted bail as Sections 42(1)(2) of the Narcotic Drugs and Psychotropic Substances Act, 1985 Act have not been complied with. The same rule may be applied to this application also. Hence, the applicant deserves bail.

ORDER

(i) The application is allowed.

(ii) The applicant Shaikh Mainoddin Shaikh Alimoddin be released on bail on executing P.B. and S. B. of Rs. 50,000/- ( Rupees fifty thousand) with one solvent surety in the like amount in connection with the above crime, on the conditions that :- (a) He shall not tamper with the prosecution witnesses. (b) He shall attend the trial on each effective date. (iii) Needless to state that the above observations are restricted to bail purpose only.
