29TH SEPTEMBER, 2015 ORDER:

After hearing learned counsel for the parties at length, on instructions, they resile to a situation whereunder there can be directions to the trial court to decide and dispose of regular civil suit no.66 of 2008 expeditiously having regard to the controversy involved in the matter.

Since all other stages, upto the stage of evidence, are over, it would be expedient that the learned Civil Judge, Junior Division, Mukhed decides regular civil suit 66 of 2008 within a

WP-8040.15 period of six months from the date of receipt of writ of this order. Till then, learned counsel for respondent, on instructions from respondent, fairly states that his client would not create third party right, title or interest in the suit property.

Accordingly, with directions as aforesaid, writ petition stands disposed of.
