Applicants apprehend arrest in connection with Crime No. 084/2023 registered with Tamalwadi Police Station, District Osmanabad for the offece punishable under Section 306 read with Section 34 of Indian Penal Code.

First informant is the father of deceased who committed suicide on 30th May, 2023. It is his contention that his daughter was married and after said marriage present applicants were causing harassment to her. It is alleged that being fed up by the said harassment, she committed suicide.

Learned counsel for applicants submits that infact it was the deceased who was calling the applicants which indicates that the allegations in the First Information Report are incorrect. According to him, it is not a case of abetting to commission of act of suicide by deceased.

Though learned APP opposed the application, perusal of investigation papers indicate that there was conversation between deceased and one of the accused indicating close relationship between them. Apart from this, statement of husband of deceased indicates that on the date of incident, the said fact was revealed to him. Thus, this Court fnds substance in the contention of learned counsel for the applicants that for this reason the deceased might have committed suicide. In view of this, application is allowed in terms of the interim order.
