By order dated 11.7.2024 writ petition is placed for hearing after calling for record from the office of the Respondent no.4.

By the present application, it is contended on behalf of the Bank that the interim protection granted by this Court under order dated 11.7.2024 is in the nature of blanket injunction. It would be contrary to the law laid down by the Division Bench of this Court in case of Shevalkar Developers Ltd., Nagpur Vs. Rupi Cooperative Bank Ltd., Pune reported in 2016 (1) Mh.L.J. 382.

It is made clear that the order dated 11.7.2024 was passed only with intention to get necessary record from the

ca 7551.24.odt Inquiry Officer i.e. Respondent No.4 and interim protection was extended so that hearing of the writ petition itself can be concluded. It is, therefore, made clear that interim protection granted would continue only till 22nd August, 2024 and parties are put to notice that matter would be heard finally at the stage of admission.

Place the matter in the urgent category on the given date. In case matter is not heard, the Bank would be at liberty to seek vacation of interim relief.

Civil Application stands disposed off.
