Heard the learned counsel appearing for the petitioner and learned A.P.P. for the State. The grievance of the petitioner made in the petition is that though the appeal filed by the petitioner challenging the externment order dated 20.4.2015, passed by the SubDivisional Officer, Parbhani is assailed before the Divisional Commissioner and as a matter of fact, after hearing the parties, the Divisional Commissioner has reserved the matter for judgment/ order, still no judgment/ order is pronounced. In our opinion, the petition is premature, in the sense that the appeal filed by the petitioner is not yet finally decided. We hope and expect that the Divisional Commissioner may pronounce the final judgment/ order in Appeal No.39/2015 within two weeks from today. Petition stands disposed of in above terms.
