IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD 926 WRIT PETITION NO. 7182 OF 2014 WITH CA/3929/2015 IN WP/7182/2014 NARAYAN DAGADU YAMALWAD AND OTHERS

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS ...

Advocate for Petitioners : Mr. Pathan Hamzakhan I. Mr. VH Dighe, AGP for Respondent/State.

----- CORAM :

S.S.SHINDE & P.R.BORA,JJ.

DATE : 7 th April,2015.

PER COURT :

1) Heard. We have perused the annexures annexed with the civil application. It appears that already advertisement dated 11th March, 2015 for recruitment of 32 posts of Kotwals in Loha Taluka is issued in Daily Lokmat on 20th March, 2015. By way of filing this civil application, the petitioner/applicant seeks stay of the said advertisement.

2) In our opinion, no writ jurisdiction can be exercised thereby controlling the activities of the respondents, which would fall within the domain of the respondents. In this view of the matter, the Civil Application stands rejected. 3) It is needless to observe that the petitioners would be entitled to participate in the new recruitment process; and if the procedure

of recruitment prescribes that weightage to be given to the experience, the concerned authority will consider the same, taking into account the experience possessed by the petitioners.

4) The writ petition also stands disposed of.
