Perusal of the application shows that the delay of 113 days in preferring appeal against the judgment and decree passed in RCA No. 90/2016 dated 18/12/2018 is satisfactorily explained. No malafides can be attributed to the applicants in not preferring the appeal in time. Hence, Civil Application No. 8606 of 2019 is allowed in terms of prayer clause 'A'.
