Advocate for Petitioner : Mr. Deshpande Milind K. AGP for Respondent/State : Mr. S.B. Yawalkar ...

CORAM : RAVINDRA V. GHUGE & S.G. MEHARE, J.J.

DATED : 18th AUGUST, 2021 PER COURT:- 1.

We have heard the learned counsel for the respective sides. 2.

It is undisputed that the petitioner is armed with a Revenue Recovery Certifcate (RRC) acquired under Section 33-C(1) of the Industrial Dispute Act, 1947. Grievance is that respondent no.1 - District Collector, Beed is not doing the needful.

3.

We have perused the communication from the District Collector, Beed dated 15.09.2020 addressed to the Chief Ofcer, Nagar Parishad, Beed to take steps with regard to the RRC issued to the petitioner. We fnd that the District Collector has to issue appropriate orders. The RRC has to be executed by treating the amount as arrears of land revenue and steps have to be taken in view of the provisions of the Maharashtra Land Revenue Code, 1966.

4.

As such, this petition is disposed of with a direction to respondent no.1 to abide by the provisions of the Maharashtra Land 1/2

937-wp-8455-2020.odt Revenue Code and take steps to recover the amount set out in the RRC by treating the said outstanding amount as arrears of land revenue. Such action should be completed on or before 15.10.2021 and shall further ensure that the amount is delivered to the petitioner, who is a pensioner, on or before 30.10.2021.
