Though learned counsel for the respondent-insurer has strongly resisted the application on various grounds, however, considering that the injury sustained by the applicant resulted into permanent disablement and the applicant has also incurred substantial amount towards medical expenses, the applicant is permitted to withdraw the amount to the extent of 50% on furnishing undertaking to the satisfaction of the Commissioner for E.C. Act & Judge, Labour Court, Latur. The Civil Application is accordingly disposed off. ( V. K. JADHAV, J. ) vre/-
