PER COURT :

1) In morning session, when the present matter was taken up for hearing, learned counsel appearing for the parties jointly submit that the dispute amongst the parties has been amiably settled and the Consent Terms have also been prepared and are signed by the parties. The consent Terms were also tendered across the Bar, duly signed by the parties and their respective counsel.

2) The learned counsel appearing for the parties were requested to appear before the learned Registrar (Judicial) and to get verified

the consent terms. Accordingly, the parties appeared before the learned Registrar (Judicial) of this Court and got verified the terms of compromise.

3) The learned Registrar has also submitted his written report in that regard and the same is taken on record.

4) The parties are present before the court accompanied by their respective counsel.

5) On perusal of the terms of compromise, it does not appear to me that anything contrary to law is mentioned in the said consent/compromise terms. The compromise terms appear to be legal and valid.

6) In view of the above, the present second appeal stands disposed of in terms of the compromise arrived at between the parties. The compromise terms/consent terms shall form part of the decree to be prepared of the second appeal. (P.R.BORA) JUDGE bdv/
