IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD REVIEW APPLICATION NO. 120 OF 2015 IN WRIT PETITION NO.6044 OF 2015 Chandrashekhar Ramrao Patil APPLICANT

VERSUS

Shashikant Ramrao Patil & others RESPONDENTS .......

Mr. Sumit S. Agrawal, Advocate for the applicant Mr. V. C. Solshe, h/f Mr. M. M. Patil, Advocate the respondents .......

[CORAM : SUNIL P. DESHMUKH, J.] DATE : 14 th AUGUST, 2015 ORDER :

1.

This civil application has been moved purportedly seeking review of the order dated 25th June, 2015.

2.

While the order was passed, it had been taken into account that plaintiff's application for temporary injunction had been rejected by the trial court and plaintiff's miscellaneous civil appeal had been allowed. However, said order had been stayed by the appellate court pursuant to its powers under Order XLI, Rule 5 of the Civil Procedure Code.

3.

This court, while had passed the order, had taken into

{2} ra120-15 account that the parties are closely related and under the circumstances, the suit be proceeded with as expeditiously as possible and had directed disposal of the same within a period of four months and had continued the order of the appellate court referred to above.

4.

Thereafter, after about one and half months, complaints are being lodged against each other alleging disturbance in respect of possession of each of the party over the suit property. The applicant has expressed apprehension of mishap and untoward incident.

5.

The application does not refer to any of the grounds on which review can be maintained.

6.

In view of aforesaid, I am not inclined to entertain the review application. In case occasion arises it is open for the parties to make suitable applications before the trial court. [SUNIL P. DESHMUKH, J.] drp/ra120-15
