By this petition, the petitioner is seeking direction to declare him as a successful bidder and to issue the work order. 3.
By way of communication dated 10 July 2024, the respondent - employer cancelled the tender process and proposed to initiate a fresh process.

It reveals from the record that in all there were four bidders in the fray. Out of that, two were disqualified in the technical bid. One of the bidder withdrew from the bidding process. Petitioner is the only technical bidder, who successfully completed the technical bid. However, the respondent has proposed to undertake a fresh process.

We are of the considered view that it is the discretion of respondent no. 2 to undertake a fresh process. No fault can be found with the same while exercising the discretion. 6.
Writ petition is disposed of.
