IN THE HIGH COURT AT BOMBAY

APPELLATE SIDE, BENCH AT AURANGABAD 957 WRIT PETITION NO.7127 OF 2014 BHARAT SHAMRAO TIKTE

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS ...

Advocate for Petitioner : Mr. D.A. Mane AGP for Respondent/State : Mr. M.M. Nerlikar ...

CORAM : T.V. NALAWADE AND SUNIL K. KOTWAL, JJ.

DATED : 23/01/2019.

PER COURT :

1.

The petition is filed for setting aside the communication made by Divisional Secretary Latur Division with the employer of the petitioner by which the employer was directed to start domestic enquiry in respect of the misconduct of the petitioner. No interim relief was granted by this Court. In view of this circumstance and as only communication of the Education Board is under challenge, this Court holds that no relief can be given in this matter. When there is such serious allegation, domestic enquiry needs to be held and the petitioner will have to face that enquiry. The petition stands dismissed. [SUNIL K. KOTWAL, J.] [T.V.
