The main prayer clause (A) in this petition no more survives because as stated by learned counsel for the petitioner the investigating agency has filed B-Summery before the Magistrate's Court. Learned counsel for the petitioner states that the petitioner has already taken steps by filing protest petition. Therefore, prayer clause (A) does not survive. As far as other prayers are concerned, the subject matters are different and they cannot be mixed with prayer clause (A). Therefore, the petition is disposed of with liberty to the petitioner to adopt appropriate proceedings in accordance with the law for the reliefs claimed in prayer clauses (B) and (C). The petition is disposed of accordingly.
