Heard learned counsel for the applicants and the learned APP for the respondent-State. 2.

The applicants are the account holders who did not know how the Manager of the Bank has played fraud and transferred the money to their account. The applicants were also unaware of the account handled by the Bank Manager. The applicants run the Bachat Gat. A loan of Rs.8,74,500/- each was sanctioned to their Bachat Gut. Therefore, they

(2) 925-aba-988-2022 were under the impression that loan had been sanctioned to their Bachat Gat for disbursement. They never knew the illegalities committed by the Bank Manager. Therefore, Anticipatory Bail may be granted to them.

The learned APP would submit that, the amount was transferred to the account of the applicants and it was immediately got transferred to the other accounts. However, the prosecution has no case that the applicants have played the active role in misappropriating the money. The documents further reveal that the Bank Manager has misused the amount of the various account holders. In view of the fact this Court is of the view that the applicants may be protected. Hence, the following order:

ORDER

a. The applications are allowed.

b. The interim protection granted to the applicants by order dated 28.07.2022 and 10.08.2022 are confirmed on the same terms and conditions of the bail bond.
