The learned Counsel for the petitioner submits that the validation proceeding is pending since October - 2019. The employer has issued notice directing the petitioner to produce the validity or else adverse action would be taken.

The learned AGP accepts notice for all the respondents. 3.

In view of the fact that the validation proceeding is still pending, we pass the following order.

ORDER

(i) The impugned notice is quashed and set aside. (ii) The petitioner shall appear before the Respondent - Committee Gajanan

on 15-09-2021.

(iii) The Committee shall thereafter endeavour to decide the proceeding within six months.

(iv) The petitioner shall co-operate in expeditious disposal of the proceeding.

(v) The employer may not take adverse action against the petitioner only on the ground that the validation proceeding is pending.

(vi) The employer may take further course of action depending upon the judgment that would be delivered by the Committee in the validation proceeding.
