Heard the learned counsel for the applicant and learned APP for the respondent/s-State.

The applicant seeks bail in Crime No.250 of 2024, registered with Karmad Police Station, District Aurangabad, for the offences punishable under Sections 304-B, 498-A, 504, 506 read with Section 34 of the IPC.

The applicant is a father in law of the deceased. The deceased found hanged in the house of the applicant within a year of her marriage. The allegations have been levelled against the applicant and his family that in the marriage, dowry of Rs.1,50,000/- paid and balance was remained to be paid. She was harassed for the balance dowry. The parents of

the deceased were convincing the family members of the applicant that they would pay the balance dowry. They should not harass her for the dowry.

Learned counsel for the applicant submits that the allegations are general. The parents of the deceased were not financially good to pay such a huge dowry. However, she hanged herself in the house. The false allegations have been levelled against the applicant. Nothing is to be recovered from the applicant. Hence, he may be granted bail. 5.

Learned APP has strongly opposed the application. He would submit that the investigation is in progress. The offence is serious. The deceased was harassed and treated cruelly for the balance dowry. Hence, bail may not be granted. 6.

It seems that the general allegations have been levelled against the applicant for the harassment and treating the deceased cruelly for the balance dowry. Except this, there are no allegations against the applicant. No incriminating evidence/material is recovered from him. He is in Government Service. Considering the allegations levelled against him and the role attributed to him, he deserves bail. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant GANPAT BABURAO PATHADE be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of like amount, on the following conditions :

(a) He shall not tamper with the prosecution witnesses.

(b) He shall attend the Police Station as and when called by the Investigating Officer on written notice till filing charge sheet.
