Pratik Navnath Sarwade v. Sumant Bhange Through Its Secretary
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 95 CONT. PETITION NO.509 OF 2022 IN WP/10445/2021 PRATIK NAVNATH SARWADE
VERSUS
SUMANT BHANGE THROUGH ITS SECRETARY ...
Advocate for Petitioner : Mr. M. P. Gandle AGP for Respondent/State : Mr. S.G. Sangle ...
CORAM : RAVINDRA V. GHUGE & ARUN R. PEDNEKER, JJ.
DATED : AUGUST 23, 2022.
PER COURT :
1.
This Court had directed vide order dated 3rd December, 2021, in Writ Petition no. 10445/2021 that, "The respondent No.1 may take appropriate decision in accordance with law and policy pursuant to the report submitted by the Commissioner, Social Welfare (page
38) so also the inquiry report, preferably within six months" 2.
The petitioner concedes that the concerned authorities have taken a decision on 10.6.2022, which they should have taken, on or before 3rd June, 2022. The delay is of seven days. 3.
This Court had expected respondent no. 1 to take a decision. It was not ordered that the decision should be taken in a particular manner. Once the decision is taken, the necessary ingredients to hold the respondent in contempt for disobeying the order of the Court, i.e. willful, deliberate and intentional disobedience, are missing from this case.
4.
In view of the above, this petition stands dismissed. [ARUN R. PEDNEKER J.] [RAVINDRA V. GHUGE, J.] SSC/
