Heard Mr. Narwade, learned counsel appearing for the applicant and Mr. Joshi, learned APP appearing for the respondent-State.

One Sangita Narayan Pachore lodged complaint to the police station alleging that on 21.05.2017 at about 2.30 p.m. her daughter went out side the house by saying that she is going towards tailor, but she

2 CrAppln 3398/17 did not return. Thereafter the informant took search of her daughter. She also verified that another accused Pravin Dake disappears from his house. So on suspicion that Pravin might have kidnapped the daughter of informant, filed the complaint.

During the course of investigation statement of the victim came to be recorded before the learned Judicial Magistrate First Class Newasa. On perusal of her statement it appears that, she herself eloped with another accused Pravin Dake by taking necessary articles, clothes etc. It is also stated by the prosecutrix that, when the another accused Pravin came to take her in Indica Car at that time this applicant and another accused persons were in the car. They travelled up to Shevgaon and thereafter the victim and another accused Pravin went further by bus.

In view of the allegations, I am of the opinion that, no specific role is attributed to the present applicant. The applicant was arrested on 23.06.2017. He was available for custodial

3 CrAppln 3398/17 interrogation. In view of the above, and the nature of the allegations against the present applicant, I am of the opinion that the applicant is entitled for bail. Hence, following order.

O R D E R

(1) Application is allowed.

(2) The applicant shall be released on bail in connection with Crime No.65/2017, registered with Sonai Police Station, District Ahmednagar, on his executing P.R. Bond of Rs.15,000/- [Rs. Fifteen thousand only] with one solvent surety in the like amount.
