It is an application moved by the original appellant to fix his appeal for final hearing.

Heard Mr Govind Kulkarni holding for Mr Devang Deshmukh, learned counsel for the applicant and Mr P.G. Borade, learned APP for the State.

Learned counsel for the applicant submitted that it is a case under the Prevention of Corruption Act. The trap was laid in the year 2007 and appellant/applicant came to be convicted under the Prevention of Corruption Act. His appeal is of the year 2014. All the pensionary benefits of the appellant/accused are held up since appeal is pending. He, therefore, prays to fix his appeal for final hearing. 4.
On the other hand, Mr P.G. Borade, learned APP for the State pointed out that the criminal appeals right from the year 2004 are pending before this Court. They are in the queue. It may not be appropriate to take
2 914-Cri.Appln-2537-2022 this appeal of 2014 by giving special treatment. He, therefore, opposed to fix this appeal for final hearing.

I find merit in the submissions of Mr Borade, learned APP for the state. The appeals right from the year 2004 are pending before this Court for final hearing. It may not be appropriate to give special treatment to this criminal appeal which is of the year 2014. As such, the prayer stands refused. Hence, this criminal application stands disposed of.
