The learned counsel for the applicant submits that the Reference Court has passed the ex-parte order as against the present applicant and thus the delay has occurred in filing the appeal.

The learned counsel for the respondent nos. 2A, 2B and 3, strongly resisted the application on the ground that, the delay has not been explained satisfactorily.

In view of the above submissions and for the reasons stated in the civil applications, delay of 720 days caused in filing the first appeals is hereby condoned. Civil applications are allowed and accordingly disposed of.
