The applicant is seeking pre-arrest bail, in connection with C.R. No.118 of 2016, registered with Manwat police station, Tq. Manwat, District Parbhani, for offences punishable under sections 4 and 5 of the Explosive Substances Act, 1908.

While relying upon the permit issued under the Explosive Substances Act in favour of the applicant and the permit to transport explosive substances, learned Counsel appearing on behalf of the applicant would submit that when the earlier bail application was argued, these documents were not available.

In my opinion, this Court distinctly remembers that all these aspects were duly gone into and thereafter only, the applicant had withdrawn earlier application.

In view of above, there is no subsequent development to re-consider the same issue.

At this stage, Mr Kakade, learned Counsel appearing on behalf of the applicant, submits that in C.R. No.118 of 2016, registered with Manwat police station, Tq. Manwat, District Parbhani, the applicant shall surrender on 18th August, 2016. The statement is accepted as an undertaking. 6.

The vehicle/explosive substances are already attached and the coaccused are also arrested. The statement of the applicant is accepted as an undertaking, that he shall surrender on 18th August, 2016. I, therefore, pass following order :- Till then, in the event of arrest of the applicant, in connection with C.R. No.118 of 2016, registered with Manwat police station, Tq. Manwat, District Parbhani, for offences punishable under sections 4 and 5 of the Explosive Substances Act, 1908, he be released on ad interim bail, on furnishing P.R. Bond of Rs.10,000/- with one surety in the like amount. The order of interim pre-arrest bail shall operate till 17th August, 2016, i.e. the date on which the applicant has undertaken to surrender.
