This is an application for condonation of delay of 216 days in filing the second appeal.

I have heard the learned Advocates of both the sides. 3.

Considering the nature of the dispute, for the reasons mentioned in the application, the delay does not appear to be either deliberate or intentional. The delay is condoned subject to payment of costs of Rs.5,000/- (Rs. Five Thousand) to be deposited in this court within four weeks from today. Civil application stands disposed of. 4.

On such deposit being made, register the second appeal. The respondent shall be entitled to claim the costs.

After registration of the second appeal, issue notice to the respondent in the second appeal.
