This is a civil application for condonation of delay of two (02) days in filing second appeal.

Heard learned counsel Mr. Kanawade for the applicant and learned counsel Mr. Mandlik for the respondent.

Learned counsel for the applicant submits that delay of two (02) days in filing second appeal is not intentional, it is because of the communication gap between the party i.e. the applicant and his advocate. 4.

Learned counsel appearing for the respondent objected on the ground that there is no sufficient ground to condone the delay.

I perused the record and on considering the reasons disclosed from paragraph No. 7 onwards, the grounds stated therein are sufficient for condone the delay of two (02) days in filing second appeal. Hence, the following order.

ORDER

(I) The application stands allowed.

(II) Delay of two (02) days in filing second appeal stands condoned. (III) Office to register the second appeal accordingly. ( BHARAT P. DESHPANDE, J.) P.S.B.
