Petitioner-original plaintiff is before this court purportedly in respect an order passed on 29-04-2015 upon an application Exhibit-5 in regular civil suit no.252 of 2015, under which the court has issued notice to respondents-defendants making the same returnable on 1206-2015, since the court felt it necessary to hear other side. 2.

Learned counsel for the petitioner states that he has instructions that defendants, accordingly have been served in the matter. 3.

As such, I am not inclined to grant any indulgence to the petitioner. It is open for the petitioner to proceed with the remedy already being prosecuted.

Petition stands disposed of.
