IN THE HIGH COURT OF JUDICATURE AT BOMBAY BENCH AT AURANGABAD 64 CIVIL APPLICATION NO.6250 OF 2019 IN FAST/21597/2018 VITHAL GENA CHAVAN (DIED) LRS ARJUN

VERSUS

THE STATE OF MAHARASHTRA ...

Advocate for Applicant : Ms. L. R.

Thakur h/f.

Mr. Patil Laxmikant C.

AGP for Respondent - State : Mr. P. M. Kulkarni ...

CORAM : SANDIPKUMAR C. MORE, J.

DATE : 12.12.2022 PER COURT :

Heard rival submissions.

The applicants/original appellants are seeking condonation of delay of 3747 days which appears to be caused due to their financial crisis. The learned AGP strongly opposed the application on the ground that there is also circulation delay.

2.

Considering the statutory right of the applicants, the delay of 3747 days stands condoned subject to condition that the applicants shall not claim any interest for the aforesaid period of delay as well as the delay in circulating the matter belatedly. 3.

The appeal be placed for admission after removal of office objections, if any.

4.

The application is accordingly disposed of.
