This petition is filed for giving direction to the respondent to consider the petitioner's claim for appointment on the post of Conductor, lower grade. 2.

Both sides are heard.

The contentions made in the petition and the submissions advanced show that in response to the advertisement of the M.S.R.T.C. Published in the newspaper dated 7th August, 2012, the petitioner applied for the post of Conductor, lower grade. The eligibility conditions were [i] 10th standard examination pass [ii] knowledge of Marathi language including reading and writing Marathi [iii] licence obtained from R.T.O. For the post of Conductor and the batch [iv] capacity to give surety. There were other conditions i.e. high weight etc. But, in the present matter, the condition with regard to licence is involved.

It appears that by the communication from M.S.R.T.C. dated 6th June, 2013, it was informed to the petitioner that she was not holding aforesaid licence at the relevant time and so, she was not entitled to get the appointment on the said post. The submissions made on record shows that when the date of advertisement was 7th August, 2012, the last date for filing application was 5th September, 2012. The

3 WP 6578/13 petitioner obtained the licence on 6th September, 2012 i.e. not within the prescribed period. In view of this circumstance, we hold that no direction is required to be given in respect of claim of the petitioner. In the result, Writ Petition stands dismissed.
