The petitioner has challenged the judgment and order delivered by the Labour Court, Nanded dated 12/09/2017, in complaint (ULP) No. 10/2017. The statutory revisional remedy under Section 44 of the MRTU and PULP Act, 1971, has not been availed of.

As is laid down by this Court in the matter of Engineering Employees Union Vs. Devidayal Rolling & Refineries Private Limited, 1986 Mh.L.J. 331 : 1986 (2) Bom. C.R. 246 and Cifford Rebello Vs. Hotel Oberoi Towers, 2001, III CLR 805 Bom., that the Writ Petition would not be

In view of the above and since limitation is not prescribed under Section 44, this petition is disposed off with liberty to the petitioner to avail of the revisional remedy before the Industrial Court.
