PER COURT :- 1.

The petitioner contends that as a result of the interim order passed by this Court in Writ Petition No.833/2016, the respondents did not issue authorization, permitting the petitioner to excavate the sand. The petitioner contends that he had deposited a sum of Rs.22,75,000/- being a successful bidder at the auction conducted by the respondent State.

Since the petitioner was not allowed to excavate the sand, the amount deposited by him needs to be refunded. The reasonable request made by the petitioner stands allowed. The respondents are directed to refund Rs.22,75,000/- deposited by the petitioner as expeditiously as possible, preferably within a period of six weeks from today. The Writ Petition stands disposed of accordingly.
