IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 944 WRIT PETITION NO. 8262 OF 2024 RAMDAS SURYABHAN KHADE

VERSUS

THE STATE OF MAHARASHTRA THROUGH SECRETARY AND ANOTHER ...

Mr. N. L. Jadhav, Advocate for the Petitioner Mr. R. S. Wani, AGP for Respondents Stte

CORAM

: RAVINDRA V. GHUGE & Y. G. KHOBRAGADE, JJ.

DATE : 6th August, 2024 ORDER:

1.

The Petitioner desires that the pending Enquiry No. 171 of 2018, alongwith Exh. 31, should be decided out of turn, within six months.

2.

The learned AGP submits that there are several litigants who are in queue. All are awaiting adjudication of their proceedings. Merely because the Petitioner could approach this Court, does not mean that this Court should issue a direction to permit the Petitioner to jump the queue and get his proceeding, decided out of turn. Each litigant has to come in queue.

3.

We are in agreement with the contentions of the learned AGP. We would not order an out of turn hearing of the matter by jumping the

944wp8262-24 queue, when there are several litigants waiting before the concerned authority, for an adjudication of their change reports. 4.

This Writ Petition is, therefore, disposed off with the observation that the proceedings of the Petitioner would be decided in queue with the pending cases. However, if an interlocutory application like Exh. 31, is pending for orders, the same may be considered and can be decided expeditiously and preferably within a period of 60 days. ( Y. G.
