This is a case wherein disobedience is clearly visible. In Writ Petition No.15697/2023, this Court had passed an order on 02.01.2024, permitting the Petitioner to make an application in the format prescribed under Section 21 of the Bombay Police Act 1951. The earlier application was found to be vague.

It is obvious that the Petitioner also has violated our directions. In our order dated 02.01.2024, we found that the application already tendered was very vague. In paragraph no.4, we specifically directed the Petitioner to file a proper application in the format prescribed under Section 21 of the

( 2 ) 72 cp 674.24 Bombay Police Act and the Rules framed thereunder. Yet the Petitioner has not filed an application in proper format and tendered a letter addressed to the District Collector, on the letter head of the Society. Nevertheless, the Competent Authority could have out-rightly rejected the application within a period of 120 days, that we have granted, on the ground that it was not in proper format. As such, the disobedience is on the part of the Petitioner as well as on the part of the Respondents.

In these circumstances, we find it inappropriate to conclude that the Respondents are guilty of contempt. This Contempt Petition is, therefore, dismissed.
