Mr.Gade, learned Counsel for the petitioners submits that the petitioner's qualification is that of a Fitter. The petitioner had applied for the post of Assistant (Junior) as

2 18-WP-7866 per the advertisement issued by the respondents - M.S.R.T.C. He submits that even the subsequent advertisement issued by the respondents shows the said qualification to be proper qualification for the post of Assistant (Junior).

On the last date, the learned Counsel for the respondents was asked about the eligibility of the petitioner to be considered for the post of Assistant (Junior).

The learned Counsel for the respondents, upon instructions from the respondents, states that the petitioner would be considered on merit for the post of Assistant (Junior) and he would be deemed to have the required qualification. The said statement is accepted.

In view of the above, the respondents - M.S.R.T.C. shall consider the petitioner for the post of Assistant (Junior) as stated above and if

3 18-WP-7866 he is found in merit, the respondents shall act accordingly. This exercise be done within four weeks from today.

The Writ Petition is allowed and disposed of accordingly.
