PER COURT :- 1.

The petitioner is aggrieved by the order dated 25.7.2013, by which, the execution proceedings of decree passed in RCS No.125 of 2008 is stayed till the final decision in Civil Misc. Application No. 40 of 2012.

I have considered the strenuous submissions of the learned Advocates of the respective sides. The petitioners are without any interim relief in this matter for the last about four years. Civil Misc. Application No.40 of 2012 is still pending. 3.

Considering the above, I find that the ends of justice would be met by directing the learned Joint Civil Judge J.D. Patoda, to decide Civil Misc. Application No.40 of 2012 as

WP/6444/2013 expeditiously as possible and preferably on/or before 28.2.2018. 4.

With the above directions this petition is disposed off. ( RAVINDRA V. GHUGE, J. ) ...
