PER COURT :- Heard learned Counsel for the applicant and learned AGP appearing for the respondents - State.

It is informed that the State has deposited 50% of the amount under the award. The learned Counsel for the applicant prayed for the withdrawal of the said entire amount. The learned AGP submitted that the award is exorbitant and needs scrutiny by this Court.

Having considered the submissions made by the learned Counsel for the parties, I am inclined to pass the following order:-

ORDER

I) The applicant is permitted to withdraw 80% of the deposited amount on submitting an undertaking to the satisfaction of the Registrar (Judicial) of this Court. Balance amount be invested in the Fixed Deposit Receipt in any nationalized bank, initially for a period of two years and if so required, for further period till the disposal of the appeal.

II) Civil application stands disposed of.

III) List the Appeals for final disposal on 04.10.2018. (P.R.BORA) JUDGE SPT
