The validation proceeding in respect of the caste claim of the petitioner is pending.

Mr. Patil, learned counsel for the petitioner submits that the result is not declared by respondents no. 3 and 4.

Considering the fact that the validation proceeding is still pending, we pass following order -

ORDER

I] The scrutiny committee shall decide the validation proceeding in respect of the caste claim of the petitioner expeditiously and preferably within a period of four (04) months from the date of appearance of the petitioner. The petitioner shall appear before the committee on 05.08.2019.

II] Respondents no. 3 and 4 shall not withhold the result of the petitioner's examination only on the ground that validation proceeding is pending.

III] If there is no other impediment and the petitioner is otherwise eligible, then respondents shall not refrain the petitioner from prosecuting further studies of the 4th year only on the ground that validation proceeding is pending.

IV] The respondents may take further course of action depending upon the judgment

3 wp 8666.19 that would be delivered by the scrutiny committee in the validation proceeding.

V] The petitioner may make payment of the fees for the 4th year in installments to the institution and the same would be subject to the decision that would be given by the committee in the validation proceeding.

Writ Petition is accordingly disposed of. No costs.
