Heard Mr. Chondhekar, learned Advocate for the petitioner. 2.

Dispute raised in the present writ petition is about reservation of Scheduled Tribe in Ward No.1. Affidavit is filed by the Nayab Tahsildar. Para 7 of the affidavit reads thus:

" I say and submit that, the above formula adopted to village Borkhedi P in Ward No.2 as per population of the Schedule tribe reservation seat shall not be released to the scheduled Tribe. Due to over site and rush of work and also time limit schedule, the Borkhdi P ward No.1 seat was wrongly reserved." 3.

In view of the aforesaid, grievance of the petitioner, at present, stands redressed.

In case any further illegality is committed, the petitioner would have a fresh cause of action to agitate against the same. 5.

Writ petition disposed of. No costs.
