WP 8020/2016

IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD 931 WRIT PETITION NO.8020 OF 2016 MAHALAXMI MAHILA BACHAT GAT THROUGH ITS PRESIDENT MEERA SACHIN PISE

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS ...

Advocate for Petitioner : Mr. Latange V.P.

Ms. RP Gour, AGP for Respondents: 1 & 2;

Mr. Aghav Avinash D. Adv. For R/3;

Mr. Katneshwarkar P.R., Adv. For R/6 ----- CORAM :

T.V.NALAWADE & SANGITRAO S.PATIL,JJ.

DATE : 7 th MARCH,2017.

PER COURT:

1) This petition is filed for giving directions to the respondents to continue the work of supply of Take Home Ration, which is given to the petitioner. 2) The submissions made by the petitioner and the record show that, by following due process, the Committee has selected the petitioner - Mahila Bachat Gat for supplying the Take Home Ration for Bhokardan1(Rural) and accordingly the work order was issued on 1.7.2013 and tenure of such contract was of three years only.

.

It appears that the contract period is over.

It further appears that subsequently, the Government

WP 8020/2016 has issued some Circular and directed to continue the work for supply of Take Home Ration for one or two months. That period is also over.

3) Learned Counsel for the petitioner submitted that subsequently also after December 2016, the Government gave directions to the concerned to continue the work to the institution like the petitioner for further period also. Even if the said directions are there, that direction is not on the basis of right of the petitioner. This Court is avoiding to touch any aspect against the petitioner as the contract period itself is over.

4) If the petitioner has any grievance with regard to the losses sustained by it, separate recourse is open for that purpose and that cannot be considered in the present matter.

5) The writ petition stands dismissed.
