Heard learned Advocates appearing for both sides. 2.

Learned Advocate for the appellant and the learned advocate for the Respondents pointed out the judgment of this Court in Popatrao Babahari Tambe Died Through Lrs Vs. The State of Maharashtra and Another, First Appeal No.1137 of 2017 with other connected appeals, delivered on 16.07.2024 and submitted that the lands in those appeals and the present appeal pertains to the same acquisition for the construction of Tambewadi Medium

(( 2 )) 935 FA NO. 2883 OF 2009 Project under the same notification published in the Government Gazette on 05th July, 1990. They submitted that this Court in First Appeal No.1137 of 2017 with other connected appeals enhanced the amount of compensation and awarded Rs.72,000/- per acre. They further submitted that in view of the aforesaid judgment, the present First Appeal filed by the acquiring body has become infructuous and deserves to be disposed of.

Considering the submissions of both sides and in view of the aforesaid judgment, the First appeal is disposed of as infructuous. Pending civil applications, if any, also stand disposed of. [ SANJAY A. DESHMUKH, J. ] HRJadhav
