31.07.2019 P.C. :- Pursuant to the order dated 17.07.2019 the Pharmacy council of India has taken a decision on 22.07.2019 thereby granting approval to the M.Pharm (Pharmaceutics) and M.Pharm (Quality Assurance) with intake capacity of 15 and 9 students respectively.

Mr. Bagul the learned advocate submits that A.I.C.T.E. has granted extension of approval for the academic year 2019-2020 for 18 students in each of the above subject. The petitioner submits that in view of

( 2 ) 1026 wp 8504.19 the grant of approval by the A.I.C.T.E. the intake capacity as granted by the A.I.C.T.E. is required to be considered.

We have also heard the learned A.S.G. and he submits that the Pharmacy council has granted approved intake as per the infrastructure available and the faculties.

As far as intake capacity is concerned the petitioner would be entitled to admit the students as approved by the A.I.C.T.E. in view of the order of the Apex Court in case of Orrisa Technical Education V/s. A.I.C.T.E. 5.

In light of the above, the respondent no.2 shall include the name of the petitioner-college in the Centralised Admission Process for conducting the admission to M.Pharm (Pharmaceutics) and M.Pharm (Quality Assurance) with intake of 18 students in each subject. Writ petition is disposed of. No costs.
