CA No. 12328/08

IN THE HIGH COURT AT BOMBAY

APPELLATE SIDE, BENCH AT AURANGABAD 8 CIVIL APPLICATION NO. 12328 OF 2008 IN LPAST/21931/2008 WITH CA/12329/2008 IN LPAST/21931/2008 HIND SEVA MANDAL AND ANR

VERSUS

THE STATE OF MAH AND ORS ...

Advocate for Applicants : Mr. A.N. Nagargoje AGP for Respondents 1 to 3 : Mr. R.V. Dasalkar ...

CORAM : T.V. NALAWADE AND SUNIL K. KOTWAL, JJ.

DATED : March 19, 2018.

PER COURT :

1.

The learned AGP produced on record copies of decisions given by this Court in proceeding like Writ Petition No. 2881/2007 [Khandesh College Education Society Vs. Shri. Arjun Hari Narkhede & Ors.] and other connected matters decided at this seat on 9.6.2008 and Writ Petition No. 4936/2006 [V.S. Agarkar Vs. The Chairman, Grievance Cell Committee Pune University and Ors.] decided at Principal seat on 22.1.2007. They are taken on record. 2.

The learned counsel for management has gone through those decisions. It is not disputed that those decisions

CA No. 12328/08 have become final. Directions were given in those proceedings to the Management to pay the amount and then claim the reimbursement from the Government if there was grant-in-aid in respect of those posts. As the matter is no more res-integra and similar decision is given by this Court in writ petitions, there is no arguable case in LPA and so, there is no question of condonation of delay. In the result, Civil Application No. 12328/2018 stands disposed of as dismissed. Other civil application is also disposed of.
