This is an application for grant of bail under section 439 of the Code of Criminal Procedure. The applicant has been arrested in connection with C.R. No.I-221 of 2015, registered with Pathardi Police Station, District Ahmednagar, for offence punishable under section 420 of the Indian Penal Code. The accusation against the applicant appears to be that he had purchased onion worth Rs.1,37,500/- from the complainant, however, has not paid the consideration as promised.

Prima facie, the accusation against the applicant appears to be arising out of contractual obligations.

Be that as it may, the applicant was arrested and ornaments worth

(2) criap3961.15 Rs.3,00,000/- and his four wheeler is already seized by the Investigating Officer.

In view thereof, in my opinion, it will be appropriate to order release of the applicant on bail, on the following terms :- Criminal Application stands allowed.

Applicant-accused Narayan Nabaji Matkar, be released on bail, upon furnishing P.R. Bond of Rs.15,000/- with one surety of the like amount, on condition that he shall not tamper with the prosecution evidence.
