The learned Counsel for respondent opposed request for transfer on the ground that the proceedings initiated by the applicant are subsequent to the one initiated by the respondent. 2.

Given an option as to whether respondent is ready and willing to bear the conveyance charges and other expenses for making applicant to attend the proceedings at Nashik, there is no response from the respondent.

Considering the distance between Ambajogai and Nashik, which is about 350 Kms. and the fact that applicant is residing with her parents at Ambejoai, looking to the hardship and convenience, it will be appropriate, in my opinion, to allow the application in terms of Prayer Clause "C".
