PER COURT :- 1) Learned Counsel appearing for respective parties jointly pray for passing similar order, as has been passed in CA No.935/2016 in FA No.715/2016 on 1st July, 2016 passed by this Court. A copy of the said order is placed on record.

2) In view of the submission so made, the following order, -

ORDER

i) The appellant - acquiring body has already deposited 50% of the awarded amount before the Reference Court and the original claimants have BDV

IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD withdrawn the said amount before the Reference Court.

ii) At present remaining 50% amount is deposited before this Court. Out of the said amount, the applicants are allowed to withdraw the amount to the extent of 50% (i.e. 25%) on furnishing undertaking to the satisfaction of Registrar (Judicial) of this Court and the remaining amount shall be kept in any Nationalized Bank.

iii) Civil Application for withdrawal of the amount is disposed of.
