Heard learned counsel for the petitioner and learned AGP for the respondents-State.

The petitioner claims to belonging to Tokre Koli, Scheduled Tribe and is in receipt of tribe certificate issued by the competent authority, certifying accordingly. The tribe certificate issued to the petitioner has been referred for verification to respondent No.2- the Scheduled Tribe Caste Scrutiny Committee, Nandurbar Division and the proposal is stated to be pending. The petitioner has been admitted to Engineering Course as against the seat reserved for Scheduled Tribe category in Respondent No.4- Raisoni College of Engineering, Jalgaon. As a result of failure of the petitioner to submit tribe validation 1/2
941.odt certificate, respondent No.3- North Maharashtra University has not declared result of the IInd Year Engineering examination of the petitioner.

In the facts of this case, respondent No.3 University is directed to declare result of the petitioner for the IInd Year Engineering examination forthwith and if the petitioner is found eligible, respondent No.4 College shall permit him to secure admission to the next year engineering course without insisting for submission of the validation certificate. Admission of the petitioner to the Engineering course with Respondent No.4 College shall be subject to the outcome of the tribe certificate verification proceedings pending with respondent No.2 Committee. 4.
Respondent No.2 Committee is directed to take decision on the tribe certificate verification proposal of the petitioner as expeditiously as possible, preferably within a period of six months from today. 5.
Writ petition is accordingly disposed of.
